On Tuesday 28th January 2025, Mr. Phairach Pornsomboonsiri, the Attorney General, welcomed Mr. Liu Zhongyi, Assistant Minister of the Ministry of Public Security, the People’s Republic of China and his delegation. The purpose of the visit was to exchange views on extradition and international cooperation between the People’s Republic of China and the Kingdom of Thailand.

On December 9, 2024, at 3:00 PM, Mr. Phairach Pornsomboonsiri, the Attorney General, welcomed H.E. Han Zhiqiang, the Ambassador Extraordinary and Plenipotentiary of the People’s Republic of China to the Kingdom of Thailand, and his delegation. The visit was to pay a courtesy call to congratulate the Attorney General on his appointment as Attorney General and to express gratitude to the Office of the Attorney General of the Kingdom of Thailand for its longstanding cooperation in the field of justice. Furthermore, in 2025, the People’s Republic of China and Thailand will celebrate the 50th anniversary of the establishment of diplomatic relations, reaffirming their commitment to judicial and law enforcement collaboration. The meeting was held at the reception room on the 9th floor of the Office of the Attorney General, Ratchaburidirekrit Building, Chaeng Watthana Road, Bangkok.
The National Commission of Supervision (NCS) of China met with the Deputy Attorney General, Mr. Jumpon Phansumrit, to enhance cooperation on anti-corruption efforts between the two countries and to discuss extradition cases on December 6, 2024.

From October 22-24, 2024, Mr. Boworn Boonlop, Provincial Public Prosecutor attached to the office of the Attorney General and Miss Supattanee Puchadapirom, Assistant Provincial Public Prosecutor, were appointed as representatives of the Office of the Attorney General to attend the 6th Prosecutors’ Network Meeting on Maritime Law, the Tabletop Exercise on Maritime De-escalation, and the 15th Maritime Law Enforcement Dialogue Regional Plenary Meeting in Kuala Lumpur, Malaysia with 14 other maritime law enforcement agencies from Indonesia, Malaysia, the Philippines, Thailand, and Vietnam. Mr. Boworn Boonlop, head of the Thai delegation, presented Thailand’s maritime legal framework during the meetings.

On 17 September 2024, Mr. Jumpol Phansumrit, Deputy Attorney General, along with a team of prosecutors from the International Affairs Department, welcomed Mr. Dieter Wurche, Customs Liaison Officer from the Embassy of the Federal Republic of Germany in Thailand, on the occasion of his official introduction after assuming the position of Customs Liaison Officer in Thailand. Thai delegates attend a 10-day training program in China from May 12 to 21, 2024
To implement the Joint Declaration of the 13th China-ASEAN Prosecutors-General Conference and to enhance cooperation and exchange between the Supreme People’s Procuratorate of the People’s Republic of China and the Office of the Attorney General of the Kingdom of Thailand, 13 Thai prosecutors from the Office of the Attorney General of Thailand participated in a 10-day training program. Led by Mr. Sathaporn Phakdeewong, Deputy Director General of the Department of Criminal Litigation, the delegation attended sessions on “Prosecutor’s Role in Combatting Telecom Fraud and Cybercrimes” at the China-ASEAN Prosecutors Exchange and Training Base in Nanning, Guangxi, China, from May 12 to 21, 2024.

Mr. Igor Viktorovich Kranov, the Prosecutor General of the Russian Federation, together with his delegation paid Ms. Naree Tantasathien, the Attorney General of the Kingdom of Thailand, a visit on Thursday, 23 March 2023. The purposes of the visit were to discuss on international legal cooperation as well as to sign the “Program of Cooperation between the Prosecutor General’s Office of the Russian Federation and the Office of the Attorney General of the Kingdom of Thailand for 2023-2024.” Furthermore, the delegation visited the Thai Parliament and also went to the Office of the National Anti-Corruption Commission. The delegation returned to the Russian Federation at 19.35 hrs.

A Visit of Assistant Attorney General Kenneth Polite
The Assistant Attorney General Kenneth Polite, along with other delegates from US Department of Justice (US DoJ), paid an official visit to Ms. Naree Tantasathien, Attorney General of Thailand. The meeting was held on Friday, February 10, 2023 at Guest Reception Room. Mr. Polite and the delegation took this occasion to congratulate on Ms. Naree’s historic appointment and express their gratitude for the decades of solid relationship between OAG and US DoJ especially on the 30th anniversary of mutual legal assistance treaty.
The OAG Delegation to attend a Research Visit on Asset
Recovery Management in the U.S.
Mr. Jumpon Phansumrit (Deputy Attorney General), Miss Somjai Kesornsiricharoen (Director General) and the delegation of the International Affairs Department, the Office of the Attorney General attended a Research Visit on Asset Recovery Management in Washington DC during January 23-27, 2023. In this occasion, the delegation together with Mr. Tanee Sangrat, Ambassador of Thailand to the U.S., had a meeting with Mr. Bruce Swartz, the Deputy Assistant Attorney General of the U.S. Department of Justice on cooperation in the area of mutual legal assistance in criminal matters and extradition. Both sides showed appreciation toward excellent cooperation between the Office of the Attorney General and the U.S. Department of Justice. The meeting also talked on a possibility to commemorate the 40th anniversary of the Extradition Treaty this year.

Office of the Attorney General (OAG) of the Kingdom of Thailand:
Roles and Functions
Under the Constitution of the Kingdom of Thailand B.E. 2560 (2017), the Office of the Attorney General (OAG) is designated as one of the independent organizations under the Constitution, as mentioned in Section 248. The OAG is the principal agency responsible for criminal prosecutions, providing legal advice to state agencies, representing the government in court, and facilitating international cooperation in criminal matters. The OAG operates autonomously in its prosecutorial functions and the administration of justice without any political influence. The personnel management, budgetary affairs, and other activities of the OAG are also independent and separate from those of ordinary civil servants.
One notable responsibility of the OAG is its extraterritorial investigative power. When an offense punishable under Thai law is committed outside the Kingdom of Thailand, the Attorney General serves as the responsible inquiry official, as stipulated in Section 20 of the Thai Criminal Procedure Code. Additionally, the OAG facilitates international cooperation in criminal matters, with the Attorney General acting as the Central Authority in Mutual Legal Assistance in Criminal Matters (MLA) and Extradition, and also as the Central Authority under the Hague Convention on the Civil Aspects of International Child Abduction.
These enhanced roles and responsibilities empower the OAG to render justice to people both domestically and internationally. The OAG responds to the current pattern of crimes, increasingly perpetrated not only within the jurisdiction but also across borders in the form of transnational organized crimes. Moreover, the OAG continues to collaborate closely with prosecutorial agencies in different jurisdictions to facilitate inter-agency cooperation.
Authorities and Functions
The main authorities and functions of the OAG, both domestically and internationally, include:
- National Interests Safeguard
Public prosecutors act as legal counselors to government agencies and state enterprises, providing legal advice and reviewing draft contracts. They also represent government agencies in lawsuits involving civil, tax, labor, or administrative matters. - Criminal Justice Administration
• Investigation
Generally, public prosecutors do not have investigative power. For criminal cases, the police are solely responsible for the investigation upon receiving a complaint. Once completed, the prosecutor evaluates the evidence and determines if the case should proceed to court. However, public prosecutors do have investigative power in specific instances such as juvenile cases, post-mortem inquests, extraterritorial offenses, and special case investigations.
• Prosecution and Trial
The public prosecutor examines the evidence submitted by the inquiry official and determines whether it is sufficient to issue a prosecution or non-prosecution order. If a prosecution order is made, the public prosecutor files an indictment with the court and presents all relevant evidence. The public prosecutor also handles claims for restitution or compensation on behalf of injured persons and can appeal judgments to higher courts if necessary. - Civil Rights Protection and Legal Aid Provision
Public prosecutors represent individuals seeking court orders to endorse their legal rights, such as managing an ancestor’s property or adopting a child. They also provide legal aid to economically challenged individuals residing in Thailand and abroad, offering services like legal advice and dispute settlement. Various offices have been established for these purposes, including the Executive Director’s Office for Consumer Protection and the Office of International Human Rights Protection. - International Cooperation
The OAG plays a significant role in international cooperation concerning the prevention and suppression of transnational organized crime, including money laundering, human trafficking, and internet defamation. The Attorney General acts as the Central Authority for mutual assistance in criminal matters and extradition, and under the Hague Convention on Civil Aspects of International Child Abduction. The OAG is also responsible for countering transnational organized crime and ensuring compliance with relevant international agreements. The International Affairs Department is a crucial organ supporting this aspect of the OAG’s mission. - Research and Legal Development
The OAG keeps up with new trends in legal issues through its Department of Technical Affairs, which reviews related laws and regulations and serves as the center for research and legal development. The Nitivajra Institute, established on October 1, 2020, supports the OAG’s policy initiatives. It aims to develop Thailand’s justice system based on international principles and standards, fostering cooperation with national and international stakeholders.

| Mutual Legal Assistance The Attorney General of Thailand acts as the Central Authority of Thailand for cooperation with foreign counterparts in the matters of mutual assistance in criminal matters. The public prosecutor in International Affairs Department handles and processes all formal requests for assistance in accordance with the provisions of the Mutual Legal Assistance in Criminal Matters Act of Thailand and Mutual Legal Assistance Treaties between Thailand and bilateral partners. Thailand currently concluded bilateral treaties with Australia, Belgium, Canada, China, France, India, Republic of Korea, Norway, Peru, Poland, Sri Lanka, Ukraine, the United Kingdom and the United States of America, while the ASEAN countries shall be subjected to multi-lateral treaty so-called ASEAN MLAT. | Extradition The purpose of extradition is to prevent crimes and to punish the criminals escaped from the punishment and reside in another country. The extradition process enables governments to bring back the fugitives for prosecution, standing trial and serving sentence. The Attorney General of Thailand is the Central Authority for extradition matters. International affairs Department handles and processes all incoming and outgoing requests for extradition in accordance with the provisions of the the Extradition Act B.E. 2551 (2008) and any applicable extradition treaty with foreign countries. Requests for extradition Thailand can extradite fugitives to the requesting countries in accordance with the provisions of the Act and the applicable extradition treaty on the basis of Double Criminality, Double Jeopardy, Rule of Specialty and Rule of Reciprocity. The extraditable offence shall not be either the political or military offence. | International Cooperation in Civil Matters regarding Breach of Custody Rights The Attorney General or the designated person as ‘the Central Authority’ has the power and duty to coordinate the provision of assistance under the Act on International Cooperation in Civil Matters regarding Breach of Custody Rights B.E. 2555 (2012) (‘the Act’) as follows: 1. Receiving the application for assistance from the applicant; 2. Considering and determining whether or not to provide or seek assistance; 3. Cooperating with the Central Authority or the Competent Authority of a foreign country including following up and accelerating the prompt return the child and fulfilling the objects of the Act; 4. Locating the whereabouts of the child being removed or retained under the Act; 5. Undertaking to protect the child from harm or prevent all interested parties from an unjust treatment; 6. Undertaking to secure the voluntary child return or to bring about an amicable and equitable resolution of the issues; 7. Exchanging the information of the child; 8. Providing information relating to the laws of Thailand on the implementation of the Act; 9. Undertaking to effectively secure the child return or exercising the access rights; 10. Providing public prosecutors, legal counsel or advisors for effectively securing the child return or exercising the access rights; 11.
