On 28 November 2023, H.E. Mr. Evgeny Tomikhin, the Ambassador of Russia to Thailand, together with his delegation, paid a courtesy call on Mr. Amnat Chetcharoenrak, Attorney General of Thailand, to congratulate on his inauguration. During the meeting, both sides shared views on various current issues of cooperation to strengthen

On November 3, 2023, His Excellency Dr.Han Zhiqiang Ambassador of the People’s Republic of China to Thailand, paid a courtesy call on Mr. Amnat Chetcharoenrak, Attorney General of Thailand. On 2 November 2023 at 10:30 hrs. Her Excellency Dr. Angela Macdonald, Ambassador of Australia to Thailand, paid a courtesy call on Mr.Amnat Chetcharoenrak, Attorney General of Thailand to congratulate him on his promotion to Attorney general of Thailand and initiate discussions concerning cooperation between Australia and Thailand in the framework of Australia –Thailand Strategic Partnership.

Ambassador to Thailand

On 7 April 2023, Mr. Robert F. Godec, U.S. Ambassador to Thailand, along with the representatives from the International Narcotics and Law Enforcement Affairs Office, the Department of Justice, the Federal Bureau of Investigations, the Department of Homeland Security, and the Drug Enforcement Agency, had a courtesy meeting with Ms. Naree Tantasathien, Attorney General of Thailand to discuss opportunities to advance the long-standing partnership between Thailand and the United States in the justice sector.

A Courtesy Call from Mr. Igor Viktorovich Krasnov,

the Prosecutor General of the Russian Federation

Mr. Igor Viktorovich Kranov, the Prosecutor General of the Russian Federation, together with his delegation paid Ms. Naree Tantasathien, the Attorney General of the Kingdom of Thailand, a visit on Thursday, 23 March 2023. The purposes of the visit were to discuss on international legal cooperation as well as to sign the “Program of Cooperation between the Prosecutor General’s Office of the Russian Federation and the Office of the Attorney General of the Kingdom of Thailand for 2023-2024.” Furthermore, the delegation visited the Thai Parliament and also went to the Office of the National Anti-Corruption Commission. The delegation returned to the Russian Federation at 19.35 hrs.

An Introductory Meeting from Dr. Angela Macdonald,

Australian Ambassador to Thailand

On 20th February 2023, Dr. Angela Macdonald, Australian Ambassador to Thailand, had an introductory meeting with Ms. Naree Tantasathien, Attorney General of Thailand, and the delegation from International Affairs Department at the Office of the Attorney General. Dr. Angela also took this occasion to congratulate Ms. Naree on her appointment and share her appreciation for a strong relationship and collaboration with the Office of the Attorney General on behalf of Australia.

A Visit of Assistant Attorney General Kenneth Polite

The Assistant Attorney General Kenneth Polite, along with other delegates from US Department of Justice (US DoJ), paid an official visit to Ms. Naree Tantasathien, Attorney General of Thailand. The meeting was held on Friday, February 10, 2023 at Guest Reception Room. Mr. Polite and the delegation took this occasion to congratulate on Ms. Naree’s historic appointment and express their gratitude for the decades of solid relationship between OAG and US DoJ especially on the 30th anniversary of mutual legal assistance treaty.

The OAG Delegation to attend a Research Visit on Asset

Recovery Management in the U.S.

Mr. Jumpon Phansumrit (Deputy Attorney General), Miss Somjai Kesornsiricharoen (Director General) and the delegation of the International Affairs Department, the Office of the Attorney General attended a Research Visit on Asset Recovery Management in Washington DC during January 23-27, 2023. In this occasion, the delegation together with Mr. Tanee Sangrat, Ambassador of Thailand to the U.S., had a meeting with Mr. Bruce Swartz, the Deputy Assistant Attorney General of the U.S. Department of Justice on cooperation in the area of mutual legal assistance in criminal matters and extradition. Both sides showed appreciation toward excellent cooperation between the Office of the Attorney General and the U.S. Department of Justice. The meeting also talked on a possibility to commemorate the 40th anniversary of the Extradition Treaty this year.

Information Service

Mutual Legal Assistance               
The Attorney General of Thailand acts as the Central Authority of Thailand for cooperation with foreign counterparts in the matters of mutual assistance in criminal matters. The public prosecutor in International Affairs Department handles and processes all formal requests for assistance in accordance with the provisions of the Mutual Legal Assistance in Criminal Matters Act of Thailand and Mutual Legal Assistance Treaties between Thailand and bilateral partners.               
Thailand currently concluded bilateral treaties with Australia, Belgium, Canada, China, France, India, Republic of Korea, Norway, Peru, Poland, Sri Lanka, Ukraine, the United Kingdom and the United States of America, while the ASEAN countries shall be subjected to multi-lateral treaty so-called ASEAN MLAT.

Types of assistance
The types of mutual legal assistance that Office of the Attorney General may provide in respect of criminal matters include the following:
·  taking of evidence
·  obtaining witness’ statement
·  locating or identifying persons
·  transfer of persons in custody for testimonial purposesin foreign country
·  service of document
·  search and seizure
·  asset recovery
·  initiating criminal proceedings

Extradition         
The purpose of extradition is to prevent crimes and to punish the criminals escaped from the punishment and reside in another country. The extradition process enables governments to bring back the fugitives for prosecution, standing trial and serving sentence. The Attorney General of Thailand is the Central Authority for extradition matters. International affairs Department handles and processes all incoming and outgoing requests for extradition in accordance with the provisions of the the Extradition Act B.E. 2551 (2008) and any applicable extradition treaty with foreign countries.

Requests for extradition           
Thailand can extradite fugitives to the requesting countries in accordance with the provisions of the Act and the applicable extradition treaty on the basis of Double Criminality, Double Jeopardy, Rule of Specialty and Rule of Reciprocity. The extraditable offence shall not be either the political or military offence.

Requirement of Incoming Extradition
·  Identity and possible location of the person sought
 
·  Facts and procedural history of the case
 
·  Legal provisions (a description of the offence and applicable penalty)
 
·  Statute of limitations
 
·  Legal basis (a description of the basis upon which the request is made such as Bilateral Treaty)
 
·  Warrants of arrest or Conviction/detention order
 
 All documents need to be translated into Thai

Transmission of requests           
The extradition requests shall be sent by the Central Authority of the requesting country via diplomatic channel. The foreign Central Authorities may also direct queries regarding extradition requests by email to inter@ago.go.th
International Cooperation in Civil Matters regarding Breach of Custody Rights        
The Attorney General or the designated person as ‘the Central Authority’ has the power and duty to coordinate the provision of assistance under the Act on International Cooperation in Civil Matters regarding Breach of Custody Rights B.E. 2555 (2012) (‘the Act’) as follows:

1. Receiving the application for assistance from the applicant;
2. Considering and determining whether or not to provide or seek assistance;
3. Cooperating with the Central Authority or the Competent Authority of a foreign country including following up and accelerating the prompt return the child and fulfilling the objects of the Act;
4. Locating the whereabouts of the child being removed or retained under the Act;
5. Undertaking to protect the child from harm or prevent all interested parties from an unjust treatment;
6. Undertaking to secure the voluntary child return or to bring about an amicable and equitable resolution of the issues;
7. Exchanging the information of the child;
8. Providing information relating to the laws of Thailand on the implementation of the Act;
9. Undertaking to effectively secure the child return or exercising the access rights;
10. Providing public prosecutors, legal counsel or advisors for effectively securing the child return or exercising the access rights;
11. Undertaking other acts for the fulfilment of providing or seeking assistance under the Act
